We reserve the right, at any time, to change or modify the terms and conditions applicable to your membership. Such changes will become effective upon notification, which we may effect by sending you notice by email and posting a revised Terms and Conditions Agreement on this website, which you can access at any time using the "Terms" link. Your continued use of our service after notification of such a change has been sent shall be deemed to constitute acceptance by you of any such changes, modifications, additions or deletions. BragThis.com is a social networking site owned and operated by Advertology, LLC. The Terms and Conditions set the guidelines, rules, and code of conduct for use of this site. If you do not agree with these terms and conditions you do not have permission to use BragThis.com and its services.

We ask that you use your discretion and only post information through BragThis.com that is appropriate for viewership by others. Posting of any prohibited content as listed below will result in violation of the terms and conditions and may result in the a termination of the offender's membership. Understand that information posted is public and BragThis.com makes no claim to hide information, provide security, or other protections to any and all information posted to this site. BragThis.com allows for basic privacy settings, but does not intend this to be in anyway legally binding or imply responsibility for security of that information.

BragThis.com and Advertology, LLC. does not assume any liability for content posted through BragThis.com. BragThis.com does not condone illegal acts or activity, potentially dangerous acts or activity, defaming, or other acts intended to harm other individuals. BragThis.com does not assume liability for actions taken involving creation of material with the intent of posting to this site.

BragThis.com reserves the right to deny, refuse, remove, suspend, or terminate your access to all or part of the BragThis.com site at anytime for any or no reason. BragThis.com is not required to provide notice of explanation and does not assume liability for such actions.

1. ELIGIBILITY. Eligibility refers to use of the membership services of BragThis.com. A user must register to use the membership services of BragThis.com. By using the BragThis.com Services, you represent and warrant that (a) all registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information; (c) you are 13 years of age or older with a parent or guardian's explicit permission; and (d) are at least 18 years of age or older (e) your use of the BragThis.com does not violate any applicable law or regulation.  Your profile may be deleted and your Membership may be terminated without warning, if we believe that you are under 13 years of age or under the age of 13 without the required parental or guardian permissions, if we believe that you are under 18 years of age and you represent yourself as 18 or older, or if we believe you are over 18 and represent yourself as under 18. All contented deemed "adult content," or "adult filtered" is strictly off limits to those under the age of 18. All viewership of "adult content" must be confirmed at a special gateway affirming your age and intent. BragThis.com is does not assume any liability for viewership of "adult content."
2. LOGIN & PASSWORD. It is the member's responsibility for safe guarding his or her login name and password. You also agree not to use another member's login or password or impersonate another user for any reason. Please notify BragThis.com of any unauthorized or suspected unauthorized use of your login and password immediately. BragThis.com does not assume any liability or use of a member's login, password, or account, the member is fully responsible for use of his or her account.
3. MEMBER USAGE. BragThis.com is for personal use and may be used for promotional purposes as well. BragThis.com reserves the right to restrict or allow all direct commercial activities on BragThis.com whether the intent is for monetary gain or not. BragThis.com may remove commercial content at anytime for any reason. Illegal and or unauthorized use of BragThis.com including collection of usernames, email addresses, user id numbers, or other information pertaining to its members by electronic or other means is prohibited. BragThis.com does not allow unauthorized framing, linking, or employing a third party promotional sites or software to promote forms of unauthorized solicitation. BragThis.com reserves the right to terminate offending accounts, restrict IP address, and or take appropriate legal action for any illegal or unauthorized use of BragThis.com. BragThis.com does not assume liability for illegal or unauthorized actions taken by entities not of BragThis.com or Advertology, LLC.
4. PROPRIETARY RIGHTS OF CONTENT. BragThis.com does not claim ownership rights to text, images, photos, videos, audio, etc of member created or uploaded content. The member retains all rights to such materials posted under their account and in accordance with the terms and conditions. Upon posting content to BragThis.com you agree that BragThis.com has the permission and limited licence to display the content in the manner outlined in the terms and conditions. Upon removal of content, BragThis.com will not longer have permission to display or use in any manner removed content. All content posted must be the member's own content of has explicit licensing from the owner to post content whether it be for monetary or non monetary reasons.
5. ALLOWED CONTENT. BragThis.com may reject, refuse to post, or delete any content for any or no reason, including content that in the sole judgment of BragThis.com violates this agreement or which may be offensive, illegal or violate the rights of any person or entity, or harm or threaten the safety of any person or entity. BragThis.com assumes no responsibility for monitoring the BragThis.com for inappropriate content or conduct.  If at any time BragThis.com chooses, in its sole discretion, to monitor the BragThis.com, BragThis.com assumes no responsibility for the content, no obligation to modify or remove any inappropriate content, and no responsibility for the conduct of the user submitting any such content.
   
   The user, you, are solely responsible for the content that you post on BragThis.com.
6. PROHIBITIED CONTENT & ACTIVITY. The following are examples of the kind of content that is illegal or prohibited to post on or through BragThis.com. BragThis.com reserves the right to investigate and take appropriate legal action against anyone who violates this provision, including without limitation, removing the offending content from the BragThis.com and terminating them membership of such violators. Prohibited content includes, but is not limited to, content that, in the sole discretion of BragThis.com:
   
   • 6.1 - Content that is offensive and promotes racism, bigotry, hatred, or physical harm of any kind against any individual or group.
   • 6.2 - Harasses or advocates harassment of another person.
   • 6.3 - Solicits personal information from anyone under the age of 18.
   • 6.4 - Contains excessive nudity, violence, or offensive subject matter, or links to any material of the same.
   • 6.5 - Exploits an individual or group in a sexual or violent manner.
   • 6.6 - Consent or information that is know to the member as false, misleading or promote illegal activities. Consent that is abusive or threatening, obscene, defamatory, or libelous.
   • 6.7 - Information or continent that creates or poses a security or privacy risk to any individual or group.
   • 6.8 - illegal or unauthorized copy of another's copyrighted work such as video, audio, images, or links to content of such also including pirated materials, software, or media.
   • 6.9 - Related in any way or form to junk mail, unsolicited mass mailing, instant messaging, or spamming.
   • 6.10 - Promotes criminal activity or instructional information about illegal activities
   • 6.11 - Involves commercial activities without prior written consent from BragThis.com including contest, sweepstakes, advertising, or money schemes.
   • 6.12 - Images of another person you have posted with out their explicit permission.
   • 6.13 - Suggestive content, text, images, video, audio intended to draw traffic to the member or another member's profile or postings.
   • 6.14 - violates the privacy rights, publicity rights, copyrights, trademark rights, contract rights or any other rights of any person.
   • 6.15 - Criminal or illegal activity, including child pornography, fraud, trafficking in obscene material, drug dealing, gambling, harassment, stalking, spamming, sending of viruses or other harmful files, copyright infringement, patent infringement, or theft of trade secrets.
   • 6.16 - Advertising or solicitation of any member to buy or sell any product or service without prior written consent.
   • 6.17 - Hacking, modifying, or circumventing any system or technology used in BragThis.com website. Attempts at such are also in violation.
   • 6.18 - Use of HTML/CSS, or any scripts to alter the system or display of content in any part of the site.
   • 6.19 - Disrupting the BragThis.com website, services, or network.
   • 6.20 - Impersonating or an attempt at impersonating other member, person, entity, outside or in the system.
   • 6.21 - Sale or transfer of your profile.
   • 6.22 - Use of BragThis.com in any manner inconsistent with any and all applicable laws and regulations.
7. MEMBER DISPUTES. You are solely responsible for your interactions with other BragThis.com Members. BragThis.com reserves the right, but has no obligation, to become involved in any way with disputes between you and other Members.

9. DISCLAIMERS. BragThis.com. is not responsible and makes no warranties express, or implied as to the accuracy and reliability of the user content posted on this site. BragThis.com is not responsible for the content or opinions expressed through this website. BragThis.com is not responsible for maintaining or policing the accuracy of the information posted on this website by its Members. BragThis.com does not assume any liability or responsibility for actions taken by third party entities in cooperation with BragThis.com. Member are subject to third party terms and conditions upon utilizing their services or web sites.
   
   BragThis.com is not responsible for any technological error, bugs, glitches, or network problems and does not promise to make its system available at any time. BragThis.com is not responsible or liable for system related to maintaining communication between the user and the website such as communication lines, internet service providers, and other entities involved in this communication. Under no circumstances shall BragThis.com be responsible for any loss or damage, including personal injury or death, resulting from use of BragThis.com, attendance at a BragThis.com event, from any user content posted on or through the BragThis.com, or from the conduct of any users of BragThis.com , whether online or offline. IN NO EVENT SHALL BRAGTHIS.COM BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT DAMAGES ARISING FROM YOUR USE OF BRAGTHIS.COM, EVEN IF BRAGTHIS.COM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, BRAGTHIS.COM'S LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO BRAGTHIS.COM FOR THE SERVICES DURING THE TERM OF MEMBERSHIP.
11. INDEMNITY. You hereby agree to indemnify, defend and hold harmless Bragthis.com and Advertology LLC. and all officers, directors, owners, agents, information providers, affiliates, licensors and licensees (collectively, the "Indemnified Parties") from and against any and all liability and costs, including, without limitation, reasonable attorneys' fees, incurred by the Indemnified Parties in connection with any claim arising out of any breach by you of this Agreement or the foregoing representations, warranties and covenants. You shall cooperate as fully as reasonably required in the defense of any such claim. BragThis.com reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you.
12. MODIFICATIONS. We may modify this Agreement from time to time. Notification of changes in this Agreement will be posted on the Service or sent via electronic mail, as we may determine in our sole discretion. If you do not agree to any modifications, you should terminate your use of the Service. Your continued use of the Service now, or following the posting of notice of any changes in this Agreement, will constitute a binding acceptance by you of this Agreement, or any subsequent modifications.
13. DISCLOSURE AND OTHER COMMUNICATION. We reserve the right to send electronic mail to you, for the purpose of informing you of changes or additions to the Service, or of any BragThis.com related products and services. We reserve the right to disclose information about your usage of the Service and demographics in forms that do not reveal your personal identity.
